These Terms are governed by English law and are subject to the jurisdiction of the English courts.

By accepting the Terms & Conditions, customers agree to read all our policies of sale on this page and also the Delivery, Returns and Order Confirmation information on this and other pages on this website.

 

These are the Terms on which we sell all Goods to you. By ordering any of the Goods, you agree to be bound by these Terms and Conditions.

We may update these Customer Terms (and the documents referred to in them) and any aspect of the Service from time to time. You should review the Customer Terms periodically for changes. By using the Site you agree to be bound by these Customer Terms. If you do not agree to these Customer Terms then please do not use the Services or any part of them. We will not be liable if for any reason any of the Services are unavailable at any time or for any period.

Any personal data and other information provided by you is processed by us in accordance with our Privacy Policy. By providing any such personal data or other information you agree to the terms of our Privacy Policy.

 

PRODUCTS

 

Porcupine Rocks Ltd reserves the right to withdraw any products from this website at any time and/or remove or edit any content on this website. Although we aim to keep the Website as up to date as possible, the information, including product descriptions, dimensions and pricing, may be subject to change without notice. The images shown online and in any catalogues are for illustration purposes only. Many products are also shown with additional props but these are not included in the sale of a product unless otherwise specified.

FABRICS

 

Porcupine Rocks sells printed fabric by the meter (with a minimum order of 3 meters). Printing is organised on an order by order basis.  Each fabric has individual specifications. The fabrics are either screen printed by hand or digitally printed onto 100% natural fibre base cloths. We supply cottons, linens and hemp base cloths. And much like any natural fibre the fabrics might fade over time, especially when exposed to direct sunlight for prolonged periods. This is particularly relevant for window dressings. Double or Triple glazed windows are believed to slow the rate of damage caused by UV light, but we recommend keeping these items away from direct sunlight. Or discuss with yours or our curtain maker how best to minimise the risk of fading.

 

With regards to the fabrics shown online please be aware that the screen colour is not always a true representation of the actual print colour as monitors and digital screens may vary.

 

Our studio can provide samples of fabrics prior to you committing to buying meterage. Please note that minimal colour variations may occur between print runs. A 5% colour variation is acceptable and within industry standards.

 

Porcupine Rocks Studio can arrange for some fabrics designs to be printed in specific bespoke colours and will handle this directly on a request basis with the customer.

 

For commercial properties we can arrange for our fabrics to be treated by EUROFLAM to ensure they are within the parameters of The Regulatory Reform (Fire Safety) Order (RRFSO).

 

 

UPHOLSTERED ITEMS, SOFT FURNISHINGS & WINDOW DRESSINGS 

 

Please note that upholstered items, soft furnishings & window dressings (headboards, sofa’s, armchairs, ottomans, cushions, drum stools, occasional chairs, curtains, blinds etc) are handmade in accordance to the Furniture and Furnishings (Fire Safety) Regulations 1988 by our chosen upholsterer / curtain maker. 

 

All bespoke upholstered items made for residential will incorporate a fire retardant interliner. 

 

The upholsterer / curtain maker is responsible for the work carried out on refurbishing or making new pieces. Porcupine Rocks merely facilitates the ordering process and advises that you always confirm with your upholsterer / curtain maker that they work in accordance to the Furniture and Furnishings (Fire Safety) Regulations 1988

 

PURCHASES & ORDERS

 

To be eligible to purchase products from this website and lawfully enter into and form contracts on this website under English Law you must ensure all your contact details are correct; 

  • Name, telephone number, email and delivery address.  PO BOX addresses are not acceptable.

  • Credit or Debit cards used must be valid.

  • Must be over 18 years of age

 

 

SPECIAL ORDERS, BESPOKE & MADE TO ORDER ITEMS

 

If a client orders a specific item that is not in stock that requires individual shipping terms, then the

returns policy is the same as Bespoke / made to order items. 

 

Made to order items cannot be cancelled once the order has been placed.  If an item needs to be amended for any reason Porcupine Rocks Ltd reserves the right to charge for additional work where appropriate.  Porcupine Rocks Ltd cannot offer returns or refunds on bespoke / made to order items. 

 

PAYMENT

 

All prices are in GB pounds sterling and are inclusive of VAT at the prevailing rate (where applicable). The total cost of your order is the price of the selected products plus packaging and delivery.  

 

Porcupine Rocks will raise and invoice for all orders. Preferred method of payment is via a BACS bank transfer. For items purchased in our studio we are able to accept credit/debit cards. Regretfully we are unable to accept payment over the phone. We can also accept payment by PayPal if appropriate. Credit / Debit cards are subject to validation checks and authorisation by the card issuer.  If the issuer or your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery. 

 

International payments will be made direct with the client.

 

Porcupine Rocks reserves the right to dispatch goods until full payment has been received.

 

DELIVERIES

 

Porcupine Rocks will discuss delivery options directly with the customer.

 

International Deliveries will be priced accordingly. Delivery times may vary depending on the final destination. 

 

Risk of damage to, or loss of, the Goods will pass to you when the Goods are delivered to you. 

 

Please advise us of any damages caused during transit within 48 hours of receiving the items. Porcupine Rocks reserves the right to assess these damages. A claim will need to be made from the courier company, please respect that it may take some time to arrange a refund for damages.  

 

CANCELLATIONS, RETURNS & REFUNDS 

 

Cancellation of stock items can be made before they are dispatched.  A full refund will be made.

 

If, upon receipt of a stock item, you decide to return the item for whatever reason, please notify Porcupine Rocks Ltd within 7 days of receiving the delivery.  Please ensure that all items are returned to us in perfect condition, in its original packaging within 14 days of notification of returns via a tracked mailing service. Failure to meet these terms may result in Porcupine Rocks being unable to process a refund. 

 

Refunds, where appropriate, will be made within 14 days of receiving the returned item.

Refunds for any returns made outside the 7 day period will be at our discretion.

Porcupine Rocks is not responsible for interest charges made by credit card companies whilst waiting for returns to be refunded.

 

EXCLUDING LIABILITY

 

Porcupine Rocks Ltd does not exclude liability for: (i) any fraudulent act or omission; or (ii) for death or personal injury caused by negligence or breach of the Supplier's other legal obligations. Subject to this, the Supplier is not liable for(i) loss which was not reasonably foreseeable to both parties at the time when the Contract was made, or (ii) loss (eg loss of profit) to the Customer's business, trade, craft or profession which would not be suffered by a Consumer because Porcupine Rocks Ltd believes the Customer is not buying the Goods wholly or mainly for its business, trade, craft or profession).

 

LIABILITY GOVERNING LAW, JURISDICTION & COMPLIANCE

 

These Terms & Conditions are governed by the law of England and Wales. Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the Customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland. We try to avoid any dispute, so we deal with complaints as follows: If a dispute occurs customers should contact us directly. We will aim to respond with an appropriate solution within 5 days.
